1. Contest Description

Atlus U.S.A., Inc. (“ATLUS”) is offering the “2017 ATLUS-O-Weenie Cosplay Contest” (the “Contest”) and will determine winners and award prizes based on the criteria set forth below. The Contest begins on October 16, 2017 at 9:00 a.m. Pacific Time (“PT”) and ends at 9:00 a.m. PT on November 6, 2017 (“Overall Contest Period”). All entries must be received by 9:00 a.m. PT on November 6, 2017.

This Contest is in no way sponsored, endorsed or administered by or associated with Facebook or Twitter. You understand that any posting by you made on the social media websites Facebook and/or Twitter shall be publicly available on Facebook’s and/or Twitter’s website. Any additional personal information that you are requested to provide to ATLUS as a participant or winner of the Contest shall be controlled and processed by ATLUS. Any questions, comments or complaints regarding the Contest must be directed to ATLUS and not to Facebook or Twitter.

2. Eligibility

The Contest is open to legal residents of the United States, the District of Columbia (excluding Puerto Rico and all other U.S. territories and possessions and overseas military installations) and Canada (excluding Quebec), 18 years or older at the time of entry. Employees and their immediate families and those living in the same households, whether related or not, of ATLUS and its parent, affiliates, marketing, promotional, fulfillment, and/or advertising agencies (“Promotion Entities”) are not eligible to enter or win. Void in Puerto Rico, all other U.S. territories, Quebec, and where prohibited by law, rule or regulation. All federal, state, and local laws apply.

You can enter the Contest through our website here: www.atlus.com/aow2017. Use the registration form on the ATLUS website to submit the required information and upload an image. Entries are arranged in the following categories: Best Overall Costume, Best Persona Series Themed Costume, Best ATLUS Themed Costume, and Fans’ Choice Themed Costume. There is a limit of one (1) costume entry per person in each of the four (4) categories. You may only submit one (1) photo of your costume per entry. Past winners of any previous contests from this year may not re-use the same costume to enter again.

Entries containing lewd, offensive, or otherwise inappropriate content, such as but not limited to profanity, nudity, excessively amorous behavior and/or vulgar gestures will be rejected in ATLUS’s sole discretion. Any images submitted that depict illegal or criminal behaviors or activities will be rejected in ATLUS’s sole discretion and will immediately be provided to appropriate law enforcement officials, along with any information pertaining to said entrants. Submissions must be made by the person depicted in the submitted images. No costumed pets are permitted. Anyone making a submission that is found to be of someone other than the submitter will be disqualified and barred from all further instances of the Contest. Any entrant who is not eligible for the Contest can be disqualified in ATLUS’s sole discretion.

It is the responsibility of the entrant to ensure that they have permission to publicly display all objects or persons in their submission. Any entry, which does not comply with the official rules as stated, may be deemed invalid at the sole discretion of ATLUS.

3. Prizes & Winner Selection

One (1) “Best Overall Costume” Prize Pack – Includes one (1) $250 Amazon gift card, two (2) plush toys, and one (1) t-shirt; Approximate Retail Value (“ARV”) $370. All entries will be reviewed by a panel of reviewers composed of ATLUS employees and a winner will be selected based on the following judging criteria:

 Quality of design (50%)
 Creativity and originality (25%)
 Overall impression (25%) One (1) “Best Persona Series Themed Costume” Prize Pack – Includes one (1) $100 Amazon gift card and one (1) Persona 3 necklace; ARV $145. Entries must be of characters from a game in the Persona video game series. All entries will be reviewed by a panel of reviewers composed of ATLUS employees and a winner will be selected based on the following judging criteria:

 Creativity and originality (25%)
 Overall impression (25%) One (1) “Best ATLUS Themed Costume” Prize Pack – Includes one (1) $100 Amazon gift card and one (1) Catherine coaster set; ARV $120. Entries must be of characters from an ATLUS-branded (non-Persona series) video game released in the U.S. All entries will be reviewed by a panel of reviewers composed of ATLUS employees and a winner will be selected based on the following judging criteria:

 Creativity and originality (25%)
 Overall impression (25%) One (1) “Fans’ Choice Themed Costume” Prize Pack – Includes one (1) $50 Amazon gift card, four (4) plush toys, one (1) bag, and one (1) wall scroll; ARV $170. The winner will be selected based on the decisions of user voting (i.e., popular vote) on the ATLUS-O-Weenie contest voting page. User voting will begin on November 7, 2017 at 9:30 a.m. PT and will end on November 13, 2017 at 9:00 a.m. PT. Two (2) Additional Prize Packs (“Prize Pack 1”) – Each Prize Pack 1 includes one (1) plush toy, one (1) card set, and one (1) necklace; ARV $95. Prize Pack 1 will be awarded randomly to two (2) entrants in the Contest at the sole discretion of ATLUS. Two (2) Additional Prize Packs (“Prize Pack 2”) – Each Prize Pack 2 includes one (1) plush toy, one (1) lapel pin, and one (1) necklace; ARV $95. Prize Pack 2 will be awarded randomly to two (2) entrants in the Contest at the sole discretion of ATLUS. Three (3) Additional Single Prizes – Consists of three (3) posters. This will be awarded randomly to three (3) individuals who: (a) share ATLUS’s social posts about the Contest and (b) use ‘#AtlusOWeenie2017’ on either the Facebook or Twitter social media website. Limit one (1) single prize per person. The ARV of each single prize is $15.

NOTE: Any given entry can be determined the winner in only one (1) of the above categories.

There are a total of eleven (11) prizes available with a total ARV of all prizes of $1,230.

ATLUS reserves the right to change the prizes or terms of the Contest at any time. Winners will be asked to respond within three (3) business days with confirmation of prize acceptance and a mailing address for the purposes of prize fulfillment. Failure to respond to the prize notification within the stated time period or without the requested information will result in disqualification, forfeiture of the prize, and the selection of an alternate winner in ATLUS’s sole discretion. Unclaimed prizes will not be awarded. Prize recipient shall not be permitted to (a) replace his/her designated prize with another prize or item, (b) transfer or assign his/her designated prize to another person, or (c) substitute any prize or prize component for cash. In the event of unavailability, ATLUS reserves the right to substitute a prize of equal or greater value. All federal, state, local, and other taxes on prizes, including any applicable import taxes on prizes, are the sole responsibility of the person accepting the prize. 4. Disclaimers

ATLUS will not be responsible for any damage or loss of any prize materials during shipping or transmission, nor for any shipping or transmission error resulting in delivery failure of prize materials to winners. ATLUS will not be responsible for any data transfer error resulting in late or incomplete contest submissions. By entering this Contest, you agree to abide by the ruling of the judges. All judges’ decisions are final.

5. Data Collection

All personal information from you that is collected by ATLUS will be used solely for the administration of the Contest and in accordance with ATLUS’s Privacy Policy. By entering the Contest, you agree to all of the terms and conditions set forth herein, as well as ATLUS’s Privacy Policy, which is available at: http://atlus.com/privacy-policy

6. General

All entrants agree to comply fully with each provision in these official rules. Any person attempting to defraud, deceive, or in any way tamper with this Contest and any person who does not comply with these official rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law. If, during the Overall Contest Period, for reasons beyond ATLUS’s control (including, but not limited to, tampering or computer virus infection, voting fraud, etc.), the Contest is not capable of running as originally planned, ATLUS, at its sole discretion, reserves the right to cancel or modify the Contest, without liability and to the extent feasible, will determine winners and award prizes among entries received prior to cancellation or modification. ATLUS is not responsible for internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays.

The use of machines, computers or any automated technique (“Automated Cheats”) to enter the Contest is prohibited. ATLUS has the right to invalidate any entry if in its sole opinion the participant has engaged in the use of Automated Cheats at any time.

By entering the Contest, entrants grant ATLUS full rights to use an entrant’s name, image, and likeness (including use of an entrant’s statement(s), voice, Facebook and/or Twitter account username, post(s), tweet(s), and any other information requested by ATLUS) for advertising, marketing, and promotional purposes as ATLUS so determines in its sole discretion, in all media, worldwide, and in perpetuity without notice or compensation, except where prohibited by law.

ATLUS may contact you once via the e-mail address provided in the submission to invite you to join the “ATLUS Faithful” mailing list. ATLUS will not share your personal information with any third-party affiliates, except in promoting the Contest and its winners.

By entering the Contest, participants agree to the official rules as stated herein, without exception.

Past experience has shown a promotion/contest such as this one may generate similar submissions which closely resemble concepts and ideas developed by the Promotion Entities whether before, during or after the promotion/contest. Entrants may see a presentation that seemingly incorporates an idea or concept or includes materials similar to that contained in their entry (e.g., costume). Any similarity may be purely coincidental and is always unavoidable in light of the volume of ideas that the Promotion Entities routinely consider in the course of their content development. Consequently, the Promotion Entities must, and have adopted policies and procedures to protect themselves from potential liability and claims and as part of these official rules requires all entrants to agree that: (a) the Promotion Entities may use any and all ideas, concepts, material and expression, in whole or in part, submitted or contained in a Contest entry, or other material you submit, and all copyrights and other intellectual property rights therein anywhere in the world in perpetuity; and (b) all entries and entry materials become the property of ATLUS and will not be returned.

7. Right to Use Your Work and Information About You

By submitting an entry, you: (a) represent and warrant that your entry is your wholly original work, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) agree with all terms and conditions as set forth in these official rules; (c) warrant that you have the express permission of any individual appearing in your entry the right to use their image and if requested by ATLUS can provide written proof of such; (d) automatically grant to ATLUS an exclusive, worldwide, royalty free, irrevocable license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your entry; (e) agree that upon selection as a winner of any prize, you agree that your entry shall legally be considered a “work made for hire,” with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of ATLUS; (f) agree that upon selection as a winner of any prize, in the event your entry is considered not to be a “work made for hire,” you irrevocably assign to ATLUS all right, title, and interest in and to your entry (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade; and (g) agree that by submitting an entry, you grant to ATLUS the right to sell and otherwise distribute your entry on any of its websites or in any of its advertising and/or products without any compensation. The rights granted under this paragraph shall extend to ATLUS and its indirect and direct parent companies and their respective affiliated companies with respect to all entries and all other submitted materials related to the Contest, including those submitted by non-winners and winners.

By submitting an entry, you grant to ATLUS, its parent and affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, written and/or oral statements, and your entry for advertising and promotional purposes in promoting or publicizing ATLUS, its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e mail address, biographical information, or entry. The rights granted under this paragraph shall extend to ATLUS, its parent, and affiliated companies with respect to all entrants in the Contest, including non-winners and winners. ATLUS, however, does not have any obligation to use the winning or non-winning entries for any purpose.

8. Release of Liability and Issues of Law

By participating in the contest, all entrants release ATLUS and its indirect and direct parent companies and their respective affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Contest from any and all liability with respect to and in any way arising from: (i) participating in this Contest, (ii) acceptance or use of prizes, (iii) any injury or damage to an entrant’s or third person’s computer related to or resulting from the Contest, the entries and/or its prizes, and (iv) damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant’s participation in the Contest or downloading of information in connection with the Contest. ATLUS reserves the right to modify or cancel the Contest in the event that any portion of any website used to administer any aspect of the Contest becomes technically corrupted.

All federal, state and local laws and regulations are applicable. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF CALIFORNIA SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

9. Information about the Winners

Winners will be notified via e-mail and a public announcement of winners will be made on November 17, 2017.
